CHARLES FRANCIS STUDIO — TERMS OF SERVICE

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Customer”) and Charles Francis Studio, LLC (“Studio,” “we,” “us”), a Washington State LLC located in Kennewick, WA, governing your use of charlesfrancis.gallery (the “Site”) and all products and services offered through it.
By creating an account or placing an order, you agree to be bound by these Terms. If you do not agree, do not use the Site.
1. ELIGIBILITY & ACCOUNT
You must be at least 18 years old. You agree to provide accurate information, maintain the security of your credentials, and accept responsibility for all activity under your account. We may suspend or terminate accounts at any time for violations, fraud, or abuse.
2. PRODUCTS
We offer original artwork, fine art reproductions, giclée prints, canvas prints, and related products. We make reasonable efforts to display products accurately but do not warrant that images, descriptions, or pricing are error-free.
Color Accuracy: On-screen colors are representations only and may not precisely match the final printed product due to monitor differences, RGB-to-print color space conversion, substrate characteristics, ambient lighting, and normal printing variations. These variations are inherent to fine art printing and are not considered defects.
Print-on-Demand: Many products are made-to-order, produced specifically for each order after payment is received. Due to their custom nature, they are subject to the return limitations below.
3. ORDERS & PAYMENT
All orders are subject to acceptance by the Studio. We may refuse or cancel any order. Payment is processed through third-party processors; we do not store your full payment information. Applicable sales tax will be added per Washington State law.
4. SHIPPING & DELIVERY
Estimated delivery times are not guaranteed and may be affected by production, carrier delays, weather, or other factors beyond our control. Risk of loss passes to you upon delivery to the carrier. If your order arrives damaged, document and report within 7 days. International customers are responsible for all import duties and customs fees.
5. RETURNS & REFUNDS
Made-to-Order Products (prints, canvas, custom framing) are NOT eligible for return due to change of mind, buyer’s remorse, or subjective dissatisfaction with color or appearance. This is standard practice for custom fine art products.
If a product arrives with a manufacturing defect (misprinting, smearing, wrong item), contact us within 14 days with photos. We will reprint or refund at our discretion. Minor color variations inherent to printing are not defects.
Original Artwork may be returned within 14 days in original condition at your shipping expense.
Orders may be cancelled only if production has not yet begun.
6. INTELLECTUAL PROPERTY
Artwork is created by independent artists who retain all intellectual property rights. When you purchase a print, you buy the physical product only — you do not acquire any copyright, reproduction rights, or license to the underlying artwork. You may display it for personal, non-commercial purposes. You may not reproduce, scan, copy, or commercially exploit the artwork.
7. USER CONDUCT
You agree not to use the Site for unlawful purposes, impersonate others, interfere with the Site, use automated scraping tools, transmit malware, submit fraudulent orders, or engage in abusive behavior toward staff or artists.
8. DISCLAIMER OF WARRANTIES
THE SITE AND ALL PRODUCTS ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that products will meet your subjective expectations regarding color or aesthetic quality beyond what is objectively described.
9. LIMITATION OF LIABILITY
IN NO EVENT SHALL CHARLES FRANCIS STUDIO BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. Our total aggregate liability shall not exceed the amount you paid for the specific order giving rise to the claim.
10. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless the Studio from claims arising from your use of the Site, violation of these Terms, or violation of third-party rights.
11. DISPUTE RESOLUTION
You agree to first attempt informal resolution for 30 days. Unresolved disputes shall be resolved through binding arbitration in Benton County, Washington. You agree to waive any right to participate in class actions. You may opt out of arbitration within 30 days of accepting these Terms by written notice. Governing law: State of Washington.
12. MODIFICATIONS
We may modify these Terms at any time. Continued use after changes constitutes acceptance. Material changes will be communicated via email.
